Terms & Conditions

These Terms & Conditions have been written to be easy to understand and with as little legal speak as possible – while still being legally binding.

Summary

The Client does not need to have signed an acceptance of these Terms & Conditions for them to apply. If a Client accepts a quote then the Client will be deemed to have accepted these terms and conditions in full.

The agreement

You agree that:
 You have the authority to enter into this contract on behalf of yourself or the company/organisation you represent. You agree to provide me with everything that I need to complete the project including text, images and other information as required, and in a format specified. You will review my work and give your feedback and approval in a timely manner. All deadlines work both ways, you must also be bound by any dates we set together. You must also agree to fulfil the payment schedule set out at the end of this contract.

I agree that:
 I have the required experience and ability to perform the services offered, and I will always carry them out in a diligent and professional manner. I will also do everything possible to meet all the deadlines set but can’t be held responsible for a missed deadline if you have been late in supplying materials or giving timely approval.

Deadlines & delivery

Any deadline for your project must communicated clearly at the outset and before payment is made. Everything possible will be done to complete your project on time. However, revisions and response times play a major role in the amount of time it takes to complete your project. Therefore, the project completion date I give you is not a guarantee.

Design

Your quote sets out the number of revisions allowed for in this project. Any additional revisions may incur additional charges. If, at any stage, you are dissatisfied with how your project is progressing, you’ll must pay in full for everything produced up to that point and cancel the contract.

Copy

You are required to supply all copy/text unless this has been agreed in original quote. If you need content to be written, I can provide a separate estimate.

Images

You should supply photographs in high resolution as JPEG, TIFF or other agreed format. If you require me to source images for you, I can provide a separate estimate. All graphic files should be supplied in an editable, vector digital format such as AI or EPS.

Revisions

All changes and revisions must be supplied or confirmed in writing (where original request is made in person or by telephone).

The price set out in the supplied quote is based on the length of time I estimate will be required to achieve everything you’ve requested, plus specified revisions. If you need to change your original brief, that’s absolutely fine, however, this will result in a new contract being established.

Feedback & approval

All feedback must be as clear and specific as possible. All reasonable revisions will be honoured, however excessive revisions, tweaks and miscellaneous changes are subject to additional charges at my discretion.

Any errors that I have introduced into your content will be fixed for free. However, any edits such as typo/grammatical errors/wording changes carried over from the original supplied copy may be subject to additional charges.

I am not responsible for any revisions to a project once the project has been approved and the deliverable has been sent. If new design, coding, or edits associated with this project are needed, a new project agreement will be created.

Once a design is approved, it is considered final.
 Final means I’m happy to make changes should you request them, but all changes will be quoted and billed separately.

You must ensure you proof read carefully before approving the final design.

Website Support

6 weeks of free support is included with every new website. The 6 week period begins from the date the website handover is completed. During this period all reasonable amendments and changes – in line with original agreed brief –  will not incur a charge. After this 6 week period has passed, any further amendments will be charged at the standard support rate of £42 per hour.

Cancellations

Should you, for any reason, decide to cancel a project once it has begun, you are free to do so. You will simply be charged for work completed up to the point of cancellation, and I will send you any work completed up to that point.

Should anything happen to force me to cancel your project, I will hand over any completed work and refund you for any payments made for incomplete work.

Legal

It’s never possible to guarantee that all work produced will be 100% error-free and so I can’t be liable to you or any third party for damages, including lost profits, lost savings or other incidental, consequential or special damages, even if you’ve advised me of them. Finally, if any clause of this contract should be found to be unlawful or unenforceable, then that clause will be considered severable from this contract and will not in any way affect the validity and enforceability of any remaining clauses of this contract.

Copyright

You must guarantee that all elements of text, graphics, photos, designs, trademarks, or other artwork you provide are either owned by you, or that you have the right and permission to use them. Create4.design can not be held liable for any potential copyright infringement on material supplied by you.

Once you project is complete and ONLY when your final payment has cleared, copyright and IPR for you final artwork will be assigned to you.

I reserve the right, unless you specifically ask me not to, to display and link to your project as part of my portfolio and to write about it on websites, in magazine articles, books or anywhere I deem appropriate.

Rights of refusal

Create4.design will not include any material which is deemed to be immoral, offensive, obscene or illegal. All advertising material must conform to all standards laid down by all relevant advertising standards authorities.

Payment Schedule

30% deposit paid upfront. Work will only begin once this is received in full.

70% balance is payable on completion and not more than 14 days after receipt of the final invoice. In the case of physical (printed etc.) material, payment is required prior to delivery. For websites and online material, payment is required before content goes ‘live’.

Flexible payment options – where flexible payments are offered, these must be agreed prior to the start of any work and must be detailed in the estimate supplied. Flexible payments cannot be offered once a project has begun unless otherwise agreed by Create4.design.

Late Payments – If payment is late for any web/online service, that service may be suspended from the 30th day after the invoice date.

For all other services, statutory interest of 5% may be charged, starting from the 21st day after the invoice date.

In both instances, reminders and final warnings will be communicated in advance.
